Instead of pursuing the current plea seeking compensation and guidelines, the court advised the individual to file a civil suit specifically for damages.
The petitioner had approached the court stating they experienced 100 percent lower limb disability reportedly due to side effects from the first dose of the COVID-19 vaccine. Their original plea sought two main outcomes: the establishment of clear guidelines for addressing adverse effects following immunization (AEFI) and compensation to cover medical expenses incurred and disability caused by the vaccine reaction.
Hearing the case, the bench comprising Justices B R Gavai and Augustine George Masih expressed concern that pursuing the existing petition might lead to significant delays, potentially taking “a decade without resolution.” They indicated that filing a dedicated suit for damages could be a more direct and potentially faster route for the petitioner to seek financial relief for their alleged suffering and losses.
The court acknowledged that other similar petitions concerning vaccine adverse effects are currently pending. It offered the petitioner the option to have their case consolidated with these ongoing matters if they preferred that approach. However, the primary advice remained to consider a separate civil suit for damages.
The court’s suggestion shifts the focus from seeking broad guidelines and immediate compensation through a writ petition to pursuing a specific claim for damages through the established civil litigation process.
