Jaipur: The Supreme Court has issued notices to 107 nursing colleges and the Indian Nursing Council (INC) following a Special Leave Petition (SLP) filed by the state government concerning the regulation of nursing colleges.

The state government’s SLP challenges previous orders from the Rajasthan High Court, where both a single bench and a division bench invalidated critical components of the state’s nursing education policy.

According to the order, Justices P S Narasimha and Joymalya Bagchi presided over the hearing, issuing notices to the nursing colleges in Rajasthan and the INC.

Shiv Mangal Sharma, representing the state government, argued that Rajasthan had seen a proliferation of nursing colleges operating out of inadequate facilities, lacking proper infrastructure and a commitment to quality education.

A policy introduced on June 7, 2022, required any institution establishing a nursing college to own and operate a 100-bedded hospital to ensure credibility and quality. However, on Nov 4, 2022, a single bench struck down this policy, a decision that was upheld by the division bench on March 1, 2024, leading the state government to appeal to the Supreme Court on April 12, 2024.

The state government also argued that the High Court did not recognize the difference between the INC’s “minimum standards” and the “additional safeguards” that a state government can implement based on local conditions. The state contends that the increase in substandard institutions poses a threat to the public healthcare system due to inadequately trained professionals.
