Jodhpur, May 7, 2025: In a landmark judgment, the Rajasthan High Court has awarded a substantial compensation of Rs 1,07,13,500 to the family of a young MBBS student who tragically lost his life in a motor vehicle accident. The court underscored the importance of recognizing the future earning potential of students pursuing professional courses like medicine, rather than relying solely on rigid, minimum-wage calculations.

Background of the Case

The deceased, a promising 20-year-old MBBS student from Sampoornanand Medical College, Jodhpur, was involved in a fatal accident in 2019 while traveling from Jodhpur to Udaipur. The vehicle, driven recklessly by the son of the first respondent, collided with a motorcycle and subsequently crashed into a road divider. Despite medical intervention, the student succumbed to grievous injuries.

Initially, the Motor Accident Claims Tribunal in Bikaner awarded Rs 12,52,429 as compensation to the bereaved family. Finding this amount grossly inadequate, the parents appealed to the Rajasthan High Court for enhancement.

Court’s Reasoning and Judgment

The High Court bench, led by Justice Arun Monga, criticized the Tribunal’s approach for being “wholly unrealistic, unduly pedantic, hypertechnical and very narrow.” The Tribunal had calculated compensation based on the minimum wage of a skilled worker, ignoring the deceased’s academic achievements and future career prospects.

The court observed:

“In cases involving young professionals-in-training, courts must rise above rigid arithmetical calculations and insistence on income proof. A purely mathematical or minimum-wage-based approach risks devaluing education, aspiration, and merit – which are highly valued and zealously protected by the law.”

Drawing on precedent from the Supreme Court case Bishnupriya Panda Vs. Basanti Manjari Mohanty & Anr., the court assessed the notional monthly income of the deceased at Rs 70,000 in 2019, adding 40% for future prospects to reach Rs 98,000. After deducting 50% for personal expenses, the dependency amount was Rs 49,000. Applying a multiplier of 18, the court arrived at a compensation figure exceeding Rs 1 crore.

Additionally, the court doubled the compensation for loss of love and affection from Rs 44,000 to Rs 88,000 for both parents.

Impact and Significance

This judgment sets an important precedent in medico-legal compensation cases by acknowledging the high earning potential of future doctors and other professionals, especially when the deceased was a student with proven academic excellence. It reinforces the need for courts to adopt a realistic and compassionate approach in awarding damages, ensuring justice for bereaved families and promoting accountability in road safety.

The court ordered the insurance company to pay the enhanced compensation amount with 7% interest from the date of the original claim application.
