Jaipur, Rajasthan—In a significant move aimed at curbing violence against medical professionals, the Rajasthan government has issued revised Standard Operating Procedures (SOPs) that include a mandate for prior approval before the arrest of doctors.

The new SOPs, released by the State Home Department, are a direct response to increasing concerns about the safety and security of medical personnel in the state. Key highlights of the SOPs include:

  • Prior Approval for Arrests:
    • Doctors cannot be arrested without prior approval from a Superintendent of Police (SP) level officer. This measure is designed to protect doctors from potential harassment and frivolous allegations.
  • Swift FIR Registration:
    • First Information Reports (FIRs) related to alleged violence against doctors and medical professionals must be filed within six hours of receiving a complaint from the institution’s nodal officer.
  • Enhanced Security Measures:
    • The SOPs emphasize the need for strengthened security at healthcare institutions, including regular police patrolling, particularly at large hospitals and specialized medical facilities.
  • Medical Negligence Protocols:
    • Complaints of medical negligence will be treated with increased scrutiny. If a patient’s death occurs, a postmortem examination is mandatory.
    • A preliminary investigation, lead by an independent expert panel, must be conducted within 14 days, before further legal action is taken.
    • Expert panel opinions are required in medical negligence cases.
  • Regulations regarding medical staff actions:
    • Medical staff are prohibited from boycotting work, in order to pursue demands. They are directed to follow legal avenues to express their concerns.

The government’s decision follows directives from the Supreme Court, particularly in the wake of tragic incidents involving violence against medical professionals. Officials have stated that these SOPs are intended to create a safer working environment for doctors and ensure the smooth delivery of healthcare services.
