Chandigarh– The Punjab and Haryana High Court has overturned a previous decision granting compensation to a couple after a vasectomy procedure failed, resulting in the birth of a child. The court ruled that the conception was not a consequence of medical negligence but rather stemmed from the couple’s failure to exercise adequate care and caution following the surgery.
Justice Nidhi Gupta, presiding over the case, emphasized the distinction between medical negligence and the inherent, though small, possibility of natural conception even after sterilization procedures. The ruling referenced a Supreme Court verdict acknowledging this possibility. The court concluded that the couple did not adhere sufficiently to post-operative guidelines.
The state government, arguing against the compensation claim, had contended that the couple disregarded necessary precautions advised after the vasectomy.
During the court proceedings, the case took a dramatic turn when the husband reportedly drew a comparison between his situation and that of Lord Ram, invoking the ‘Agni Pariksha’ of Sita, seemingly to express the couple’s distress and restraint.

Based on this evidence, the court affirmed that the child born following the failed vasectomy is indeed the couple’s biological daughter, thereby dismissing any basis for social ostracization related to the child’s paternity.
