Chennai: The Madras High Court has recently ruled against a group of doctors deemed ineligible for Assistant Surgeon positions due to their failure to register with the Tamil Nadu Medical Council (TNMC) by the stipulated deadline.

The High Court bench, presided over by Justice C.V. Karthikeyan, referenced prior judicial decisions in its ruling. The bench emphasized that the doctors’ registration with the Medical Council occurred after the cutoff date.

The petitioners, all holding MBBS degrees and having completed their internships, applied for permanent registration with the TNMC between July 12, 2024, and August 12, 2024. While the Medical Council approved their applications by August 13, 2024, the doctors selected slots for certificate verification between July 16, 2024, and September 16, 2024, which fell outside the July 15, 2024, deadline.

The petitioners sought to overturn the selection list issued after the notification dated March 15, 2024, particularly concerning Clause 6B(III) as modified on May 14, 2024, arguing for their inclusion.

The court referred to a similar case, Dr.M.Sai Ghanesh Vs. Government of Tamil Nadu, where it was established that candidates must have completed their course and internship, be recognized by the Medical University, possess a Provisional Certificate, and be registered with the TNMC to be considered Registered Medical Practitioners.

The petitioners argued that they faced congestion on the registration portal, preventing them from securing slots before the deadline. They contended that their subsequent registration should qualify them for consideration, alleging mala fide intent in the rejection of their applications.

The High Court, however, upheld the sanctity of the notification, emphasizing that the deadline for registration with the TNMC was explicit and could not be altered mid-process. The court also pointed out that the initial deadline of May 15, 2024, had already been extended to July 15, 2024.

The court dismissed the argument that online application justified delays, suggesting that petitioners could have pursued physical verification of their certificates like other candidates who met the deadline.

Justice Karthikeyan’s bench concluded that the previous order in Dr.M.Sai Ghanesh Vs. Government of Tamil Nadu was directly applicable, leading to the dismissal of the petitions and denial of relief to the candidates.
