Bengaluru, May 16, 2025 – In a landmark decision, the Karnataka High Court has clarified that only designated regulatory bodies-namely the Rajiv Gandhi University of Health Sciences (RGUHS), Indian Nursing Council (INC), and Karnataka Nursing Council (KNC)-are authorized to inspect nursing institutes across the state. This ruling overrides a previous directive from the state government that had empowered district deputy commissioners to carry out such inspections.

Background and Court Ruling

The verdict, delivered by Justice Suraj Govindaraj, comes in response to petitions filed by the Karnataka State Association of the Management of Nursing and Allied Health Science Institutions and others. The petitioners challenged the state’s directive, issued by the Principal Secretary of the Health and Family Welfare Department on November 5, 2024, which instructed deputy commissioners to inspect nursing institutions based on the medical education minister’s orders.

Justice Govindaraj acknowledged the minister’s intent to protect students and parents but emphasized the importance of adhering to legal protocols. “The intent of the Minister may be noble and proper and to protect the interests of the students and parents, but taking into consideration the legal aspects, these inspections can only be carried out by the concerned specialised agencies like the RGUHS, INC, and KNC,” the court observed.

Mandate for Greater Transparency

In addition to clarifying inspection authority, the court directed RGUHS, INC, and KNC to develop online platforms to publicly share inspection reports of nursing institutes. The court specified that details such as infrastructure assessments, licenses, sanctions, and other authorizations must be made transparently available on the official websites of the respective regulatory bodies.

Further, the court instructed that information regarding legal proceedings involving nursing institutions and complaints received by the councils should also be accessible online. To enhance accountability and transparency, the court mandated the creation of systems allowing students, faculty, and parents to file grievances through these web portals.

Implications for Nursing Education

The High Court’s decision is expected to bring clarity and uniformity to the inspection process for nursing institutes in Karnataka. By entrusting inspections to specialized regulatory councils, the court aims to uphold the quality and standards of nursing education, while also ensuring greater transparency for all stakeholders.
