Baramulla, Jammu & Kashmir – February 17, 2025: In a significant move to promote public health and environmental cleanliness, the Jammu and Kashmir authorities have declared the renowned ski resort of Gulmarg and the popular tourist destination of Tangmarg as smoke-free zones. The decision comes ahead of the highly anticipated ‘Khelo India Winter Games 2025’ scheduled to take place in Gulmarg.

An official order issued by the District Magistrate of Baramulla underscored the adverse health impacts of tobacco use, identifying it as a major risk factor for several life-threatening diseases. “Tobacco consumption is a leading cause of mortality, contributing to nearly 40% of non-communicable diseases, including cancer, cardiovascular diseases, and lung disorders,” the order stated.

Legal Framework Supporting the Decision

The declaration aligns with the Cigarettes and Other Tobacco Products Act, 2003 (COTPA, 2003), which prohibits the advertisement and trade of tobacco products while regulating their production, supply, and distribution. The Act aims to protect the youth and the general public from the harmful effects of tobacco use and second-hand smoke. Specifically, Section 4 of COTPA prohibits smoking in public places, including government offices, workplaces, and canteens, reinforcing the legal foundation for the new directive in Gulmarg and Tangmarg.

Public Health and Environmental Concerns

Authorities highlighted that tobacco use and spitting of tobacco products contribute to the spread of serious diseases such as swine flu, tuberculosis, pneumonia, and gastrointestinal infections. According to the order, tuberculosis bacilli can survive in spit for up to 24 hours, posing a significant public health risk.

The new regulations also reference Section 270 of the Bharatiya Nyaya Sanhita (BNS), which deems any act causing public nuisance, injury, or annoyance punishable under law.

Enforcement Measures and Public Compliance

To ensure compliance, smoking and spitting of tobacco products have been strictly prohibited in Gulmarg and Tangmarg. Violators will face penalties under the applicable legal provisions. Authorities have urged tourists, locals, and business operators to cooperate with the directive, emphasizing the need to maintain a clean and healthy environment, particularly during the upcoming Khelo India Winter Games.

The initiative aligns with the government’s broader vision to promote sustainable tourism and protect the region’s pristine natural beauty, making Gulmarg and Tangmarg safer and more appealing destinations for visitors from across the country and beyond.
