The sale and distribution of painkillers and psychotropic drugs, including through online pharmacies, are regulated by State Licensing Authorities (SLAs) appointed by state governments under the Drugs and Cosmetics Act, 1940. These SLAs are empowered to implement provisions of the Act and rules, monitor compliance, and take action in case of violations.

In an effort to comprehensively regulate the online sale of medicines, the Government of India has proposed draft rules published on August 28, 2018. These draft amendments to the Drugs Rules, 1945, aim to incorporate regulations specific to the sale and distribution of drugs via e-pharmacies. Key provisions include the mandatory registration of e-pharmacies, periodic inspections, controls on drug distribution and sales, prohibition of drug advertisements through e-pharmacies, and a framework for complaint redressal and ongoing monitoring of these online entities.

This move is intended to ensure safer and more regulated access to medicinal products sold online, enhancing public health safety while promoting transparency and accountability within the pharmaceutical e-commerce sector.
