A woman officer serving as an inspector (ministerial) in the Central Reserve Police Force (CRPF) has taken legal action against the force, alleging that she was denied a promotion due to her HIV/AIDS status. The officer, whose promotion to assistant commandant (ministerial) was pending, claims the CRPF administration withheld her advancement solely because she is living with AIDS.

In her petition before the Gujarat High Court, the officer challenged the validity of CRPF’s Standing Order No. 04/2008 and Rule 5, arguing that these internal regulations contradict the provisions of the HIV AIDS Act 2017 and the National HIV Counselling and Testing Guidelines 2024. She contends that the denial of promotion constitutes discrimination on the grounds of her health condition, which is explicitly prohibited under current national legislation and guidelines meant to protect the rights of individuals living with HIV/AIDS.

After hearing arguments from both sides, a bench of the Gujarat High Court has reserved its judgment in the matter.
