The Supreme Court of India is set to hear a petition filed by NEET-PG 2024 candidates seeking the cancellation of the third round of All India Quota (AIQ) Counselling. The bench, consisting of Justices BR Gavai and K Vinod Chandran, will take up the matter for hearing tomorrow, Tuesday, February 4.
The petitioners, a group of NEET-PG candidates, argue that the merit-based distribution process was compromised when Round 3 of the AIQ Counselling began before the completion of Round 2 of state-level counselling in certain states, including Madhya Pradesh. This scheduling flaw, the petitioners contend, allowed some state quota candidates, who would otherwise have been ineligible, to block AIQ seats and later choose better options within the state quota.
Advocate Tanvi Dubey, who will represent the petitioners in the Supreme Court, stated, “We are asking for the cancellation of AIQ Round 3 and its fresh conduct due to these irregularities. Alternatively, we are urging the Medical Counselling Committee (MCC) to conduct a fourth round of counselling for leftover seats blocked by ineligible candidates, or to allow those who were allotted AIQ Round 3 seats the option to register for the stray round.”
The petitioners emphasize that conducting AIQ Round 3 before the completion of State Round 2 created an unfair advantage for certain candidates, disadvantaging other meritorious students. They argue that this scheduling discrepancy goes against previous Supreme Court guidelines and violates fundamental rights guaranteed under Articles 14 and 21 of the Constitution.
In their plea, the petitioners have requested the court to:
- Cancel AIQ Round 3 and conduct it afresh due to the irregularities.
- Alternatively, conduct a fourth round of counselling for leftover seats blocked by ineligible candidates.
- Provide an option for candidates allotted AIQ Round 3 seats to register for the stray round.
- Issue any other necessary directions in the interest of justice.
